Why Hemp Flower is Federally Legal

 

CBD and CBG hemp flower is not psychoactive but looks and smells like high-THC cannabis. And although hemp is legal on a federal level, some states have banned smokable hemp flower. We know these hemp laws can be confusing, so here’s an easy to understand explanation:

What Makes Smokable Hemp Buds Legal? 

When the 2018 Farm Bill was signed, hemp was removed as a Schedule I drug from the Controlled Substances Act due to its non-intoxicating properties, which in effect made hemp legal under federal law.

The bill (now law) defines hemp as having less than .3% THC, creating a legal distinction between marijuana-derived products and hemp-derived products. 

Know Your State Hemp Laws 

The new law asks for state governments to regulate hemp production. Some states have begun to regulate hemp production and sales. Some states allow hemp production but ban products derived from the hemp plant or other CBD products.
