Cannabis: Marijuana and Hemp

There are two types of cannabis: marijuana and hemp. In the United States, despite marijuana having been legalized at the state level for medical use in many states and for adult recreational use in a number of states, cannabis, other than plants of the same genus that meet the definition of industrial hemp, continues to be categorized as a Schedule I controlled substance under the federal Controlled Substances Act (“CSA”), and subject to the Controlled Substances Import and Export Act (“CSIEA”).  

The 2018 Farm Bill

On December 20, 2018, President Trump signed the Agricultural Improvement Act of 2018, which is more commonly known as the “2018 Farm Bill”. The 2018 Farm Bill legalizes hemp cultivation and declassifies hemp as a Schedule I controlled substance. Hemp and cannabinoid-infused products which exceed a delta-9-THC concentration of 0.3% are federally illegal.
